General Terms
General Payment Terms: To place an order, lock the price and receive a completion deadline, you must pay a minimum of 50% of the quoted order price. Remaining 50% must be paid upon delivery of exhibit or exhibits. If we have to store exhibits for a delivery date after they are completed the balances are to be paid for, as each is completed. Foreign clients must pay the remaining 50% when proof of completion is supplied and the exhibit is fully packed and ready to ship unless special terms are prior arranged and agreeable to purchaser and seller. Storage for larger projects will be provided for a reasonable length of time to afford the time of the delivery and installation logistics. If this length of time is excessive (past 3 months) a fair storage fee will be charged. Larger projects might also be purchased with terms of 40% down and another 30% when the project is 70% completed, with the remaining 30% due when the project is 100% completed. For foreign projects with exhibits that are being shipped in packed sets, as part of a larger project, final payment for each item will be required as they are completed and loaded for transport.
Shipping and Crating: Shipping and crating charges will be billed to the purchaser at reasonable rates. Purchaser is responsible for all charges related to national and international shipping, customs charges and crating. Upon request we can provide you with estimated shipping and crating costs. International orders take additional time for Ocean travel after they are fabricated and packed. Guarantee: 7-year warranty against defects in our workmanship; Free Life-time phone/internet technical support; Parts supply sourcing for our exhibits at reasonable prices. This guarantee is our way of pledging our commitment to stand by our design quality. Our exhibits have a long service life expectancy, with many units still functioning smoothly since we began selling our own exhibits to others in 2000. We have been building exhibits for ourselves since 1981. They are so easy to maintain and repair, that it usually takes regular museum staff only 15 to 20 minutes. If you have any trouble with a part that we designed, simply return the part and we will create a replacement and return it to you at no extra cost. For other components the individual manufacturers guarantee applies. I.E. some gearboxes have a one year warranty from the manufacturer. In such a case you may contact the manufacturer or feel free to call us and we would be glad to assist you. Our guarantee is limited by the following conditions; we will not accept charges for whole exhibits being sent to us as sending hundreds of pounds of equipment for the replacement of one part is impractical. Our offer also does not include onsite installation or labor to remove any part or perform maintenance and regular repairs as your location could be on the other side of the planet and such travel expenses would reduce our ability to offer you quality exhibits at a reasonable price in the future. Our guarantee does not cover part wear through normal usability. Liability is not to exceed the cost of our replacement parts that are shown to be defective. Disclaimer: We are confident of the safety and quality of our exhibits. We are sure after using them you will be impressed by the sturdy construction, safe rounded or beveled edges of the exhibit cases and our attention to details. As we cannot control the methods of exhibition, or maintenance and repair methods, or safety standards of exhibition after the exhibit leaves our shop, we must convey a standard disclaimer: We accept no consequential or inconsequential liability resulting from the use, lack of use, exhibition, improper repair, maintenance or misuse of our exhibits, or other associated exhibition setup and exhibition timing as we cannot control the display methodology. We also do not accept responsibility for errors in exhibition design by other companies who purchase our components and do not follow our technical and safety guidelines for display installation and design, and safe operation, which are clearly stated in every manual we write. Customers must read all manuals and operate products with proper safety guards. Refusal to follow proper safety practices is considered a violation of our company policy. Substitutions: We have never had a single case of an exhibit substitution being made. If such an issue were ever to occur based on our inability to complete a specific project we would offer a substitution equal to the value of the original exhibit with the approval of the purchaser. If the purchaser does not wish for a substitution we would accept cancellation of the specific exhibit only. All remaining exhibit purchases would remain in force and liability is not to exceed the reimbursement for the specific exhibit. Natural and Man Made Disasters: Should an issue beyond human capacity to control results in loss of our shop or key personnel we will provide an option of cancellation for whatever part of the project is not complete and reimbursement for deposits rendered for the part not completed, or completion of project or projects in a mutually acceptable time-frame. Should the client be subject to such an occurrence, to the extent that it prevents their ability to continue, they shall be held blameless for amounts still owing on the project(s) and the project(s) will be deemed canceled, or optionally upon mutual agreement delayed until a later date to afford continuance. If the purchase is cancelled The seller reserves the right to sell the exhibit(s) to another customer to resolve the loss of the seller’s time and expenses put into the project, or to keep a fair part of the deposit if sale of the exhibit(s) is not possible. For cancellations made by the purchaser or the seller, reimbursement is not to exceed the funds that seller received from the purchaser. Furthermore if the purchaser cancels the agreement, the seller reserves the right to deduct from the reimbursement the cost for materials the seller purchased in good faith for the project(s), as well as reasonable expenses for fabrication of the completed parts. If a disaster has resulted in the dire hardship for the purchaser or seller creating a cancellation on either part, a provision is to be made to accept payments on the amounts owed to either, as in a mutually agreeable time-frame.
